When a pharmaceutical company loses its patent protection, the drugmaker will have to defend against a generic competitor lawsuit. If the company loses the patent, it can bring a lawsuit to protect its patent from generic competition, a new lawsuit says.
In October, the FDA ordered the drugmaker to produce a detailed report on generic competition in the U. S. market. If approved, generic competition could be blocked by the Food and Drug Administration. However, the agency said it had no plan on blocking generic competition.
“As of mid-October, I was not taking the decision that the drugmaker’s actions would protect our rights and would allow generic manufacturers to compete on pricing,” the company’s executive vice president and chief operating officer, James L. Barrett, said in an email. “We had no idea about this until this morning.”
A generic competitor lawsuit, however, is a legal process, the FDA says. Generic manufacturers are required to meet certain criteria for competition before making a final decision on a new drug’s price. That includes submitting a price-plus-cost report to the FDA.
A generic company is required to submit its cost-savings report to the FDA. The generic company must also meet the same criteria to be eligible for approval from the FDA, the FDA said.
In a letter to the agency, the company said it did not want to “delay the launch of generic versions of our drug.” But the company did not say how many generic competitors were currently being served. The letter said the company would seek to block generic competitors to “help prepare physicians and patients for an increased level of competition.”
In addition, the letter said, “We encourage our patients to contact our office for a detailed discussion of how we can work together to protect our rights.”
Barrett said that the FDA’s decision “ensures the company’s efforts are taken more seriously than they were earlier.” He cited a 2015 study that showed that “people who are diagnosed with diabetes are more likely to have heart disease and to be overweight and to be obese than others.”
The company has filed a request for review of its request for review, the FDA said. The company said it had filed that request. The FDA has not yet decided if it will approve the request. But the agency said it would make a decision about the request. The agency had not asked for a response from the company.
Barrett said that the company is seeking regulatory approval to market a generic version of Ventolin HFA, which is a branded inhaler used to treat asthma. The generic company, which makes Ventolin HFA, had asked to market the drug in the U. and in Canada.
The company did not return a message left for the company’s public relations office in New York. The company’s press office was closed in June 2011. The press office had also not closed until December of this year.
The company said it plans to file a patent infringement suit against Ventolin HFA in the U. District Court for the Southern District of Florida. The suit was filed on Oct. 2. It involves a generic formulation of Ventolin HFA, which is sold under the brand name Ventolin. The drug, which is sold under the generic name Flixotide, is a new product designed to help patients breathe easier.
The company also said that it will make a request for review of its request for review in the U. Patent and Trademark Office. The patent office said it did not know the status of the request. But the agency asked for an exemption from the request.
